AI AVATAR OWNERSHIP, INTELLECTUAL PROPERTY & OFFICIAL USE POLICY

1. PURPOSE OF THIS POLICY

This Policy sets out the legal ownership, permitted use, intellectual property protection, liability limitations, and public protection framework relating to the AI-generated digital persona identified above (the “Avatar”).

By accessing, viewing, or interacting with the Avatar or its Content, users acknowledge and agree to be bound by the terms of this Policy.

2. DEFINITIONS

For the purposes of this Policy:

• “Avatar” means the AI-generated digital persona, including its likeness, facial design, character identity, branding elements, voice (if applicable), and all associated visual and digital attributes.

• “Company” means THEBRG Malaysia (THEBRG Enterprise 003120480-W).

• “Content” means all videos, images, scripts, captions, voiceovers, advertisements, animations, digital media, and derivative works published under the Avatar.

• “Official Accounts” means the verified accounts listed in Section 7 of this Policy.
  
  

3. OWNERSHIP & INTELLECTUAL PROPERTY

3.1 The Avatar is an original digital creation developed and commercially operated by the Company.

3.2 Subject to the terms and conditions of any third-party AI tools used in its creation, the Company retains all rights, title, and interest in, without limitation:

• The Avatar’s character identity;

• Branding and commercial identity;

• Copyright in produced Content;

• Digital likeness and visual representation; and

• Associated marketing materials.

3.3 Nothing in this Policy transfers any ownership rights to any third party.

3.4 Unauthorized reproduction, distribution, public display, modification, derivative creation, impersonation, resale, or commercial exploitation of the Avatar or its Content is strictly prohibited without prior written consent from the Company.

3.5 The digital likeness embodied in the Avatar is protected under applicable intellectual property, copyright, and personality rights laws. Unauthorized cloning, deepfake generation, impersonation, scraping, or commercial exploitation of the likeness is strictly prohibited.

4. AI DISCLOSURE & NATURE OF CONTENT

4.1 The Avatar is a digital persona created using artificial intelligence technologies and is based on the likeness of an authorized individual.

4.2 The individual whose likeness is incorporated into the Avatar has provided full consent for its creation, commercial use, and management by the Company.

4.3 The Avatar is a digitally generated and AI-enhanced representation and may not reflect the real-time actions, statements, views, or personal opinions of the individual concerned.

4.4 All Content is generated or assisted by artificial intelligence technologies and may be curated, edited, or enhanced by the Company.

4.5 The Content is provided for entertainment, informational, marketing, and creative purposes only.

4.6 The Content shall not be construed as professional legal, medical, financial, governmental, or investment advice.

5. NON-AFFILIATION & NO ENDORSEMENT

5.1 The Avatar and its Content are not affiliated with, endorsed by, or officially connected to:

• Any government authority

• Any political organization

• Any regulatory body

• Any religious institution

• Any public agency

• Any third-party corporation unless expressly stated

5.2 Any external claim of affiliation not formally announced via Official Accounts shall be considered unauthorized and false.

6. PROHIBITED USE & ETHICAL RESTRICTIONS

The Company strictly prohibits the use of the Avatar for:

• Political campaigning or propaganda

• Gambling promotion

• Adult, sexually explicit, or obscene material

• Fraudulent schemes or scams

• Illegal, misleading, or deceptive activities

• Hate speech, discrimination, or defamatory purposes

The Company maintains internal compliance standards to ensure responsible and lawful AI usage.

The Avatar is exclusively operated through the following Official Accounts:

8. ANTI-FRAUD NOTICE

8.1 The Company does not sell, transfer, or license the Avatar to third parties without formal written agreement.

8.2 The Company does not solicit investments, financial transfers, cryptocurrency payments, or private financial details via unofficial communication channels.

8.3 The public is advised to verify all communications through Official Accounts only.

9. ENFORCEMENT & LEGAL ACTION

9.1 The Company reserves the right to enforce its intellectual property rights to the fullest extent permitted by law.

9.2 Enforcement actions may include but are not limited to:

• Platform takedown requests

• Copyright infringement claims

• Civil litigation

• Claims for damages

• Reporting to relevant authorities

9.3 Unauthorized impersonation, deepfake replication, or commercial misuse may constitute infringement under applicable intellectual property and digital communications laws.

10. LIMITATION OF LIABILITY

10.1 The Company shall not be liable for:

• Third-party misuse of the Avatar

• Impersonation accounts

• Modified or altered Content not published through Official Accounts

10.2 Users rely on the Content at their own discretion and risk.

11. INDEMNIFICATION

Any individual or entity who unlawfully reproduces, distributes, exploits, or misuses the Avatar agrees to indemnify and hold harmless the Company from any claims, damages, losses, or legal costs arising from such unauthorized actions.

12. GOVERNING LAW & JURISDICTION

This Policy shall be governed by and interpreted in accordance with the laws of Malaysia, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to this Policy, including its existence, validity, interpretation, or termination, shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. REPORTING UNAUTHORIZED USE

If any unauthorized, fraudulent, illegal, or misleading use of the Avatar is discovered, please report immediately to:

14. POLICY AMENDMENTS

The Company reserves the right to amend, update, or revise this Policy at any time.
